Estos Términos de Servicio ("Términos") rigen tu uso de la aplicación móvil Sharp ("Sharp", "la app", "nosotros"), operada por Manuel Alberto Huguez Mendoza, con domicilio en C LAZARO CARDENAS 26, Pblo MAZATAN, C.P. 85560, Sonora, México. Al crear una cuenta, marcar la casilla de aceptación o usar la app, aceptas estos Términos y nuestro Aviso de Privacidad. Si no estás de acuerdo, no uses la app.
Debes tener al menos 18 años (o la mayoría de edad legal en tu país) y capacidad legal para celebrar contratos. Al usar Sharp declaras que cumples con esto.
Sharp es una plataforma tecnológica que conecta a clientes con barberías y barberos independientes, permite reservar y pagar citas, y ofrece a los barberos herramientas de gestión mediante una suscripción. Sharp no presta el servicio de barbería: el servicio lo prestan directamente los barberos/barberías, quienes son responsables de su calidad, cumplimiento y cualquier disputa relacionada con el corte o atención.
Eres responsable de la información que proporcionas y de mantener la seguridad de tu cuenta y tu PIN. Notifícanos de inmediato ante cualquier uso no autorizado. Podemos suspender o cancelar cuentas que violen estos Términos.
Puedes subir contenido (fotos de perfil, imágenes de tu barbería, documentos de verificación, etc.) ("Contenido del Usuario"). Sobre esto:
Respetamos la propiedad intelectual. Si crees que un contenido en Sharp infringe tus derechos de autor, envíanos una notificación a manuhu00@gmail.com con: (a) tu identificación y firma, (b) identificación de la obra infringida, (c) la ubicación del material en la app, (d) tus datos de contacto, (e) una declaración de buena fe de que el uso no está autorizado, y (f) una declaración de veracidad. Retiraremos el contenido infractor y podremos cancelar las cuentas de infractores reincidentes.

No debes usar Sharp para actividades ilegales, defraudar a otros usuarios, eludir los pagos de la plataforma, hacer ingeniería inversa, sobrecargar la infraestructura, ni acosar a otros usuarios.
Sharp se ofrece "TAL CUAL" y "SEGÚN DISPONIBILIDAD", sin garantías de ningún tipo. No garantizamos la calidad de los servicios de barbería ofrecidos por terceros ni la disponibilidad ininterrumpida de la app.
En la medida máxima permitida por la ley, Sharp y Manuel Alberto Huguez Mendoza no serán responsables de daños indirectos, incidentales o consecuentes, ni de disputas entre clientes y barberías. Nuestra responsabilidad total no excederá el monto que nos hayas pagado en los 12 meses previos.
Aceptas indemnizar y liberar de responsabilidad a Sharp y a Manuel Alberto Huguez Mendoza frente a cualquier reclamo, daño o gasto (incluidos honorarios legales) derivado de: (a) tu Contenido del Usuario, (b) tu uso de la app, (c) tu incumplimiento de estos Términos, o (d) tu violación de derechos de terceros.
En la medida permitida por la ley aplicable, cualquier controversia derivada de estos Términos se resolverá mediante arbitraje individual y vinculante, y no ante un tribunal, salvo reclamos de cuantía menor. Renuncias a participar en demandas o arbitrajes colectivos y a un juicio por jurado. Esta cláusula no limita los derechos irrenunciables que la legislación de protección al consumidor de tu país te otorgue.
Estos Términos se rigen por las leyes de Hermosillo, Sonora, México, sin perjuicio de los derechos de consumidor de tu lugar de residencia.
Podemos actualizar estos Términos. Los cambios materiales se notificarán en la app y requerirán tu aceptación para seguir usándola.
These Terms of Service ("Terms") govern your use of the Sharp mobile app ("Sharp", "we"), operated by Manuel Alberto Huguez Mendoza. By creating an account, ticking the acceptance box, or using the app, you agree to these Terms and our Privacy Policy. If you disagree, do not use the app.
You must be at least 18 (or the age of majority in your country) and able to enter into contracts.
Sharp is a technology platform connecting clients with barbershops and independent barbers, enabling appointment booking and payment, and providing barbers with management tools via a subscription. Sharp does not provide the barbering service itself; barbers/shops do, and are solely responsible for it and any related dispute.
You are responsible for the information you provide and for keeping your account and PIN secure. Notify us of any unauthorized use. We may suspend or terminate accounts that violate these Terms.
You may upload content (profile photos, shop images, verification documents, etc.) ("User Content"). You are solely responsible for it and represent that you have all necessary rights. You grant us a worldwide, non-exclusive, royalty-free license to host, display, and use it to operate the app. Prohibited content includes anything infringing third-party rights, illegal, defamatory, obscene, exploiting minors, or containing malware. We may review, remove, or disable any content at our discretion.
If you believe content on Sharp infringes your copyright, email manuhu00@gmail.com with the standard DMCA elements (your signature, the work, its location, contact info, a good-faith statement, and a statement of accuracy). We remove infringing content and terminate repeat infringers.

No illegal use, fraud, circumventing platform payments, reverse engineering, overloading infrastructure, or harassing users.
Sharp is provided "AS IS" and "AS AVAILABLE", without warranties of any kind. We do not warrant the quality of third-party barbering services or uninterrupted availability.
To the maximum extent permitted by law, Sharp and Manuel Alberto Huguez Mendoza are not liable for indirect, incidental, or consequential damages, nor for disputes between clients and shops. Total liability will not exceed what you paid us in the prior 12 months.
You agree to indemnify and hold harmless Sharp and Manuel Alberto Huguez Mendoza from any claim, damage, or expense (including legal fees) arising from your User Content, your use of the app, your breach of these Terms, or your violation of third-party rights.
To the extent permitted by applicable law, any dispute will be resolved by binding individual arbitration, not in court (except small-claims). You waive participation in class or collective actions and jury trials. This does not limit non-waivable consumer rights granted by your country's law.
These Terms are governed by the laws of Hermosillo, Sonora, Mexico, without prejudice to the consumer rights of your place of residence.
We may update these Terms. Material changes will be notified in-app and require your acceptance to continue.
